LOS ANGELES — Actor and musician Will Smith is facing a significant legal battle as the new year begins. Professional musician Brian King Joseph has filed a lawsuit against Will and his company.

Also, former America’s Got Talent finalist Brian filed a lawsuit against Treyball Studios Management, Inc. We learned of the lawsuit on social media on December 30, 2025.

The complaint alleges sexual harassment, wrongful termination, and retaliation. Each allegation stemmed from events during Will’s 2025 Based on a True Story tour.

Allegations Of Predatory Behavior

The lawsuit claims that Will engaged in a pattern of “predatory behavior,” alleging he was “deliberately grooming and priming” Brian.

Furthermore, these allegations claim further sexual exploitation.

Brian, who began working with Will Smith in late 2024, asserts that a series of events unfolded during the tour. He says that someone left a handwritten letter reading, “Brian, I’ll be back…just us.”

Additionally, a drawn heart was signed with the name “Stone F.” Even more creepy, Brian claims, there were wipes, a beer bottle, a red backpack, and HIV meds.

The Las Vegas Hotel Incident

As we mentioned earlier, the core of the legal filing focuses on a “traumatic series of events.”  Incidentally, one of the incidents occurred during a tour stop in Las Vegas.

• Unlawful Entry: Joseph claims he returned to his hotel room to find it had been entered without forced entry.

• Disturbing Evidence: He allegedly discovered items including wipes, a beer bottle, a red backpack, an earring, and a bottle of HIV medication belonging to a stranger.

• The Note: Most distressing was a handwritten note signed “Stone F” that read, “Brian, I’ll be back… just us,” accompanied by a hand-drawn heart.

Joseph stated he feared the individual would return to commit “sexual acts” and immediately reported the incident to hotel security, local police, and Smith’s management.

Termination And Retaliation

According to the complaint, Brian was instead “shamed” by tour management and accused of fabricating the story. He was fired five days later, with management claiming the tour was “moving in a different direction.”

An explanation Brian disputes, noting another violinist promptly replaced him. The lawsuit seeks damages for severe emotional distress, economic loss, and PTSD.

Response From Will Smith’s Team

Will Smith’s attorney, Allen B. Grodsky, has issued a strenuous denial of all claims.

“Mr. Joseph’s allegations concerning my client are false, baseless, and reckless. They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.”

The case is currently pending in the Superior Court of California, County of Los Angeles.
