Tory Lanez Is Asking The Judge For A Restraining Order
Tory Lanez Is Asking The Judge For A Restraining Order. Canadian rapper Tory Lanez (Daystar Peterson) was taken into law enforcement custody in December 2022, immediately following a Los Angeles jury’s conviction of him of three firearm-related felonies. The charges stemmed from a July 2020 incident in which he shot fellow artist Megan Thee Stallion in the feet following a party in Hollywood Hills. After being held in county jail through the conclusion of his trial, a judge officially sentenced Lanez to 10 years in state prison on August 8, 2023, and he was transferred to a California state correctional facility the following month to serve his sentence.
Tory Lanez Granted Restraining Order Against Prison Guard
Embattled rapper Tory Lanez (legal name Daystar Peterson) has achieved a rare legal victory from behind bars. A judge has granted the artist a temporary restraining order against a California prison guard.
Whom Lanez claims posed an immediate threat to his safety.
According to reports from Yahoo News, the emergency order was issued following Lanez’s claims. Allegedly, the correctional staff intended to move him into a highly volatile and dangerous section of the facility.
Fearing For His Life Behind Bars
The restraining order comes on the heels of a separate, massive legal battle. Lanez is waging war against the state’s prison system. The rapper’s defense team has repeatedly argued that his high-profile celebrity status makes him an automatic target. Especially since he is in a maximum-security setting. In other words, this type of setting makes housing decisions a matter of life or death.
Lanez’s heightened safety concerns are rooted in actual trauma. He previously survived a near-fatal prison assault. This transpired at the California Correctional Institution in Tehachapi. As detailed by The Guardian, Lanez was brutally stabbed multiple times with a homemade shank. The alleged assault was by a maximum-security inmate serving a life sentence for murder. The attack resulted in two collapsed lungs.
As a result, Lanez was airlifted to an emergency medical facility. Some of his treatments required him to be in a hospital, where he was placed on a ventilator.
Following that incident, he was transferred to the California Men’s Colony in San Luis Obispo. However, Lanez’s latest emergency filing indicates that the threat environment remains severe. And that prompted him to seek direct judicial protection from the guards tasked with overseeing him.
A Tangled Web of Restraining Orders
The legal maneuver introduces an ironic twist to Lanez’s ongoing incarceration. He has successfully secured a restraining order against prison staff. He remains subject to a separate, strict protective order outside prison lines.
As reported by Court TV, a judge previously issued a protective order against Lanez extending through 2030. That mandate was put in place after prosecutors argued Lanez was using prison call logs and external surrogates to harass and orchestrate online smear campaigns against Megan Thee Stallion.
Lanez is currently serving a 10-year prison sentence following his December 2022 conviction for assault with a semiautomatic firearm, carrying a loaded, unregistered firearm, and discharging a firearm with gross negligence.
The California Department of Corrections and Rehabilitation (CDCR) has not commented publicly on the newly issued restraining order or the specific allegations against the correctional officer involved.
