McGrath did not conclude that Kelly was free of the condition so he advised him to warn his sexual partners so they could make an informed decision on whether or not to risk contracting the disease through sexual contact.

R. Kelly: The Possibility of a Conviction

The hard evidence is this: McGrath prescribed Kelly Valtrex, a medicine known for treating genital herpes in March of 2007. Prosecutors showed medical records proving that this was indeed the case. If the prosecution can prove that Kelly infected victims with genital herpes, they have a conviction.
