This particular law states that individuals are protected from lawsuits that threaten their freedom of speech. An initial lawsuit was filed by Arianna Davis, Crystal Williams, and Noelle Rodriquez in August 2023.
Each dancer claims they were sexually harassed and discriminated against by the singer. In addition, they claim Lizzo fostered a hostile work environment.
However, some of the dancers’ claims were dismissed earlier this year. But the judge allowed the core of the case to proceed.
Having said this, Lizzo filed an appeal, claiming an attack on her First Amendment right, as stated by Black Enterprise.
So, what does this mean in layman’s terms? She, meaning Lizzo, has the right to perform and advocate for causes. In other words, because Lizzo’s music allegedly advocates for “body positivity,” she should be able to do so.
Her defense attorney, Marty Singer, is known to advocate in cases such as this.
Lawsuit Challenges With Lizzo’s Appeal

Here is some of what Judge Epstein said,
“Judges must not dissect the creative process to determine what was necessary to achieve the final product and what was not,” continued the lawyers. “By rejecting the artist’s proven experience for what is necessary to, and best enhances, her art, the trial court stepped far outside its role.”
It is not uncommon for the ‘free speech’ law to be misinterpreted. After all, what constitutes free speech is a bit diverse. Nevertheless, Lizzo is seeking to have her case dismissed.
